David Kopel, scholar and researcher at the Independence Institute, has published an excellent article entitled, "The Torah and Self-Defense."
As we at JPFO consistently point out, the right to keep and bear arms comes directly from the right to self-defense. These are moral rights, not creations of society or government. Our documentary film, Innocents Betrayed, opens with the question: "What happens when self defense is against the law?"
Mr. Kopel's article, published in the Penn State Law Review, shows how the Torah (the first five books of the Bible) and the rabbinical commentaries upon it clearly support an individual right to self-defense that includes using deadly force when necessary.
Here is Mr. Kopel's conclusion from the article:
"What can also be said, with some certainty, is that the first five books of the Bible offer nothing to support an argument that defensive violence or killing are inherently wrong. To the contrary, the law which G-d gave to the Israelites required use of deadly force in self-defense and defense of others."Deadly force was allowed in circumstances in which there was strong, but not incontrovertible, evidence that a criminal aggressor had murderous intent. Deadly force was not allowed in mere defense of property when there was not an implicit threat to the life on the property. Abraham and Moses, the greatest heroes of the Torah, both used force to protect innocents. Under the Torah, using force to protect innocents was not only a right, but a positive moral duty."
